Can You Claim Car Insurance if Wildlife Damages Your Vehicle?

With the popularity of camping trips, many are driving into forests and natural areas, which increases the chances of encountering wildlife. But if an animal damages your car, can you claim car insurance? While this might seem “unlikely,” it’s not impossible, especially for nature enthusiasts. Let’s take a closer look at whether you can file a claim if wildlife damages your vehicle and whether government-required auto insurance covers such situations.

What Are Protected and Reserved Wildlife Species?

Before discussing car insurance claims due to wildlife damage, let’s first clarify the differences between protected and reserved wildlife species, as understanding these can be important.

  • Reserved Wildlife: These are rare or endangered species, some of which are even extinct in certain areas and urgently need conservation. Thailand has identified 20 types of reserved wildlife, including the Javan rhinoceros, wild water buffalo, Bryde’s whale, and others.

  • Protected Wildlife: These animals are legally protected to prevent extinction. This includes various animals such as wild elephants, deer, and monkeys that you might encounter in forest areas or national parks.

Is it Illegal to Hit Wildlife, Such as Elephants, with Your Car?

If you accidentally hit an elephant or protected animal, you could face legal consequences under the 2019 Wildlife Preservation and Protection Act, which penalizes causing injury or death to wildlife, with penalties of up to 10 years in prison, a fine of up to 1 million THB (about $30,000 USD), or both. Additionally, if you injure or kill the animal, you may be required to pay for the animal’s assessed value. Fleeing the scene carries further penalties under Thailand’s Road Traffic Act.

Can You Claim Car Insurance if Wildlife Damages Your Vehicle?

If you plan to visit areas with wildlife, like Khao Yai National Park, and worry that your car might be damaged by animals (as seen in some news stories), don’t worry too much. If you have first-class car insurance, it generally covers damage caused by wildlife, as wild animals are considered without owners. This means it’s an “uninsured event” claim under first-class coverage, while other insurance levels may not provide this protection.

Can Government-Required Auto Insurance (P.R.B.) Cover Damage Caused by Wildlife?

If wildlife damages your vehicle and you sustain injuries, you can claim compensation under Thailand’s required auto insurance (P.R.B.). However, it only covers injury or death, not car repair costs. This coverage extends to both the driver and passengers. For more details on the specific P.R.B. claim process, consult your insurance documentation.

If you need to claim due to wildlife damage, be aware that you may have to cover the excess fee even under first-class insurance. Preparing yourself by choosing first-class coverage before traveling can give you peace of mind, especially in areas where wildlife encounters are more likely.
